1. Agreement to Terms

By accessing and using DirectFlow.io (the "Service"), operated by DIRECT FLOW LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Service Description

DirectFlow.io is a multi-channel marketing automation platform that enables businesses to send bulk emails, SMS messages, mobile push notifications, WhatsApp messages, and Facebook messages to their customers. Our Service requires read-only access to your database to retrieve customer information for marketing campaigns.

3. Acceptable Use Policy

3.1 Legal Compliance

You must only use legally obtained user lists. This means:

• All recipients must have explicitly consented to receive communications from you
• You must maintain records of consent for all contacts
• You must comply with all applicable laws including CAN-SPAM Act, GDPR, CCPA, and TCPA
• You must honor all unsubscribe requests promptly

3.2 Prohibited Uses

You may not use our Service to:

• Send spam or unsolicited commercial messages
• Send messages to purchased, rented, or third-party lists
• Send messages containing illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content
• Impersonate any person or entity
• Transmit viruses, malware, or malicious code
• Violate any applicable laws or regulations

4. Anti-Spam Policy

We have a zero-tolerance spam policy. If we detect any illegal lists or spam activity in your account:

• We will immediately suspend or terminate your access to our Service
• You will not be entitled to any refund of prepaid amounts
• We may report violations to relevant authorities
• We reserve the right to pursue legal action for damages

We actively monitor for spam indicators including but not limited to: high bounce rates, spam complaints, sending to known spam traps, and suspicious list growth patterns.

5. Account Responsibilities

You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Ensuring your contact lists are legally obtained and up-to-date
• Complying with all applicable laws in your jurisdiction
• Providing accurate and complete information to us

6. Payment and Refunds

6.1 Payment Terms

Payment terms are as specified in your subscription plan. All fees are exclusive of taxes unless otherwise stated.

6.2 Refund Policy

Refunds are provided at our sole discretion and subject to the following conditions:

• No refunds will be provided if your account is terminated due to violation of these Terms
• No refunds will be provided if we detect illegal list usage or spam activity
• Refund requests must be submitted within 30 days of payment
• Partial month refunds are not available

7. Service Availability and Limitations

While we strive to provide reliable service, we do not guarantee uninterrupted or error-free operation. We reserve the right to:

• Modify or discontinue any aspect of the Service
• Impose limits on certain features or restrict access
• Perform maintenance that may temporarily affect availability

8. Intellectual Property

The Service and its original content, features, and functionality are owned by DIRECT FLOW LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by law, DIRECT FLOW LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

10. Indemnification

You agree to indemnify and hold harmless DIRECT FLOW LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Wyoming, United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
